§ 1 Registration The registration for our courses of the current course offer must be in writing. An online registration is valid even without a signature. The registration is binding. § 2 Course Fees The course fees are to be taken from the current course plan. They are to be paid in full before the start of the course in cash. § 3 Terms of payment The course fee is due immediately after registration, but no later than 14 days after registration, at least 7 days before the beginning of the course and must be paid in cash. The course place is only firmly booked until it has been paid. If the course fee is not paid within the deadline, there is no entitlement to a course place. § 4 Resignation / Interruption A resignation is possible until 5 days before the beginning of the course. In this case, a processing fee of 10 € will apply. With resignation from 5 days before course start the entire fee is to be paid. In case of illness, a voucher can be issued, depending on the booked course minus the processing fee. When changing an appointment (eg for the purpose of illness) a processing fee of 10 € per reposted appointment is due, here the medical certificate must be presented by the doctor. A rebooking is only possible until 24 hours before the start of the course. This must be sent in writing by e-mail to empirepole@web.de, other cancellations are not valid. For all cancellations within the last 24 hours before the beginning of the course, the course fee will be fully retained and forfeited, there is no right to a refund, as we can not fill the seats in this short time. § 5 Miscellaneous The permission to attend classes is not transferable to third parties. Changes in the course plan are possible at any time. Course performance may depend on the number of participants in each case. This can lead to a cancellation of the course from the course plan. § 6 Participation Only healthy persons can participate in the training. By registering, the participant assures that he / she is in the position to participate in the booked workshop. Handicaps are to be communicated to the coach before the workshop. The trainer reserves the right to exclude the participant from the workshop and / or training. In case of delay to participate in the workshop and / or training, this is at the expense of the participant. Instructions of the trainer must be followed. In case of overbooking the organizer reserves the right to withdraw the registration. With the participation of minors (under 18 years) a declaration of consent of the parent or guardian has to be brought along. § 7 Liability The organizer is not liable for damage caused to the participant of any kind (property damage, property damage or damage to health) caused by participation in a workshop and / or training. The organizer excludes liability in principle. The participant participates in the workshops at his own risk, including the use of the classroom. The participant is responsible for any damage he causes in the classroom, changing room, gym during his stay. § 8 Holidays and public holidays During the holidays the course classes take place. There are no courses on all public holidays and on Rosenmontag. This does not create any claims against Empire Pole. § 9 Annual holidays The Empire Pole reserves the right to 8 weeks of company holidays (spring, summer, autumn, winter). Empire Pole announces the company holidays 2 months in advance through notices in the studio. There are no courses during the holidays. § 10 Copyright and Copyright All training content learned in the Empire Pole (poletricks, their names, names, all content) and provided teaching materials (images, etc.) are only for the personal use of participants allowed. All rights to names, designations, training content, characters and training concept are the property of the Empire Pole. Without consultation and written approval, none of the rights to the content may be reproduced or disclosed to third parties. This is especially true for the time after the event attended and for commercial purposes eg in the form of a trainer in another training school (eg pole school, gym, etc.). § 11 ABO system When concluding a membership contract, the general terms and conditions of the Empire Fitness apply additionally. § 11.1 Rights of the member The member is entitled to use all training devices (pole, lintels) during the prescribed training period. § 11.2 Health of the member The member is aware that the facilities of the Empire Pole may be used only with appropriate sports health. If in doubt about sports health, the member must consult a physician before registering to avoid any damage to his health. The Empire Pole accepts no liability for damage to health of the member, which was caused by indebtedness. Empire Pole can not be held responsible for any damage to health resulting from the member's use of the Empire Pole facility despite lack of sporting health. Not affected by this rule is the liability of Empire Pole for damage to health suffered by the member due to intentional or grossly negligent breach of contract by an employee of Empire Pole. § 11.3 Liability Any liability of the Empire Pole for any damage incurred by the member in the use of our facility or by claiming our service is excluded, as far as contrary to the instructions of our staff facilities are used in a grossly negligent manner. Reference is made to §11.2 of this Terms and Conditions. We are not liable for the loss of clothing, valuables and money. The liability for loss or injury resulting from the intentional or grossly negligent conduct of an employee of Empire Pole is not excluded. § 11.4 Method of Payment The agreed membership fee has to be paid in advance at the latest one week before the beginning of the course. The contribution will continue to be paid until the expiration of the contract if the services of Empire Pole are not used. The aforementioned method of payment is not applicable if the member is permanently prevented from using the facility due to a long illness (proof by a medical certificate) or change of location (at least 50km), so that he has the right to extraordinary termination. In case of late payment, Empire Pole reserves the right to charge dunning fees. If the member culpably with at least 4 weeks contributions in default, the entire remaining contribution is due immediately and the membership is terminated. Address changes are to inform Empire Pole immediately. § 11.5 Illness / Downtime If the member can temporarily not use the institution serving the training due to illness, pregnancy, vacation or professional prevention, this does not bind the obligation to pay the agreed membership fee. This provision does not affect the right of the member to extraordinary termination in the event of a permanent impediment to claim the services of Empire Pole. § 11.5.1 Long-term illness If the member can no longer take part in the course instruction due to long-term illness or in case of unfitness for sport, a medical certificate is absolutely necessary. The attest fees are borne by the member. The certificate must be submitted at the latest before the start of the new course program. Important: with retroactive effect course fees can not be reimbursed. §11.5.2 Missed lessons / changes If the member does not appear for the course, it will be canceled without replacement. Nevertheless, the full course fee is due without deduction, as Empire Pole provides all services for the member at the booked time. Should the member wish to change course, this is only possible in agreement with Empire Pole, as long as there are still places available in other courses. (See §4) § 11.6 Extraordinary termination If the usage agreement ends before the term specified in the agreement, the prices that have been used from the beginning shall be used for the period between the beginning of the current contract year until the customer's early withdrawal would have been if the contract had been known at the time the user agreement was concluded or extended. § 11.7 Modification of the user fee In the event of cost increases of wages, rental and / or ancillary costs such as electricity, gas, water, heating, etc., Empire Pole is entitled to increase the membership fee by the respective increase contribution within 2 years. The amount adjustment is effective without the consent of the member. Members will be notified 4 weeks before the amendment by written notification of the scope. § 11.8 Duration of membership / termination The present contract is extended by the expiry of the aforementioned agreed minimum term by 3 months unless 4 weeks before the end of the contract period is terminated in writing. Timely access to the notice of termination at Empire Pole is authoritative. §12 free practice lesson are only possible by prior arrangement once a week. The member is aware that the training is at your own risk and in case of damage Empire Pole is not liable. There is no claim to participation. If a free training is already booked, another date can be arranged with the employees of Empire pole. § 12 Severability clause Should individual provisions of this contract be ineffective or impracticable or become ineffective or impracticable after the conclusion of the contract, the validity of the remaining provisions of the contract remains unaffected. The ineffective or unenforceable provision shall be replaced by an effective and enforceable provision whose effects come closest to the economic purpose pursued by the contracting parties with the invalid or unenforceable provision. The above provisions shall apply mutatis mutandis in the event that the contract proves to be incomplete. § 13 Privacy All personal data will be treated confidentially. The personal data are stored in compliance with the Federal Data Protection Act within the framework of the business relationship and not disclosed to third parties. § 14 Jurisdiction German law applies. The place of jurisdiction is Bad Salzuflen (as of 19.02.2017)
